Terms of service
§ 1 Scope and provider
These terms of service govern the use of TripBriefing and all contracts concluded through this website. The provider is Daniel Fekete, phone +43 681 10232970 (further provider details in the Impressum). Our offer is directed at consumers; mandatory consumer law (in particular the Austrian KSchG and FAGG) remains unaffected by these terms. Contract languages are German and English; in case of discrepancies the German version prevails.
§ 2 Services and plans
TripBriefing produces AI-assisted hotel research and editorial travel briefings. We are not a travel agency and not a booking intermediary: we do not conclude booking contracts on your behalf. Bookings take place exclusively on the linked third-party sites (e.g. Booking.com or Agoda) under their own terms.
The scope of research is measured in "steps" (details in § 6).
- Free (€0): a one-time, lifetime step allowance: it does not renew (no monthly or other reset). A per-trip limit on the number of stops applies, and deep research is not available. Reports created on the free plan remain accessible for a limited period only; the currently applicable period is stated on the pricing page.
- Pro: a one-time purchase (no subscription) with its own, non-expiring step allowance and additional features such as PDF export and permanently stored reports. Reports you create while Pro is suspended because of a chargeback count as free reports unless you use purchased steps for them (§ 6). As long as your Pro purchase stands (that is, not after a withdrawal and not while it is suspended because of a chargeback, § 6), the list price of every step pack is lower for you than the regular list price shown on the pricing page without signing in. List price means the price before discounts, for example from a discount code.
- Step packs: additional steps as a one-time purchase. Pack steps never expire but do not include Pro features.
The currently applicable allowances, pack sizes and prices are stated on the pricing page and in the checkout. You get at least the free allowance displayed at the time of your registration; reductions apply to future registrations only. For purchased step allowances (Pro, step packs) the state at the time of purchase applies.
Preview features (such as the AI location suggestion or the event preview shown before you start a search) do not consume steps. In return they are limited in number and frequency. These limits exist to prevent abuse and runaway cost and may be adjusted. When a limit is reached, the app says so where it applies (and the search itself can be started without the preview).
Event preview with web search (Pro). If the event preview for Pro uses a web search, a cap of 50 places per account within 30 days applies, on a rolling basis: each place becomes available again 30 days after its search. Every place counts the first time its events are loaded, even if we already have them stored; the same place with the same travel months counts only once within 30 days, even across several hotel searches. A place that appears twice, separately, in a trip spanning more than two calendar months can count twice. If the web search fails after it may already have caused costs (this includes a timeout), the place stays counted; another click in the same hotel search then tries again within 7 days, as long as slots are free, and counts the place once more. Once the cap is reached, we keep showing events we already have stored for a place, without counting it; for the other places we look up the events without web search, within the limits of the previous paragraph, and say so in the preview.
§ 3 Registration and account
Using TripBriefing requires an account. Sign-in is passwordless via a time-limited login link ("magic link") that we send to your e-mail address. Keep your e-mail address up to date and protect access to your mailbox; login links are not meant to be shared. Your account and the allowances booked on it are not transferable. How we handle your data: privacy policy.
§ 4 Conclusion of contract and payment
A purchase (Pro or step pack) proceeds as follows: you select an offer on the pricing page, provide the confirmations requested there (including the one described in § 7) and are forwarded to our payment provider Stripe. Before completing the order you see the total price and all order details and can correct input errors up until you click the order button. The contract is concluded when you click the order button that is expressly labelled as creating an obligation to pay (§ 8 FAGG) and the payment is authorised. We confirm the contract without undue delay by e-mail on a durable medium (§ 10 ECG, § 7 para 3 FAGG). These terms are permanently available at /agb; you can save and reproduce them (§ 11 ECG).
§ 5 Prices, founder terms and discount codes
All prices are final prices in euros. No VAT is shown (small business exemption, § 6 para 1 no 27 of the Austrian UStG). These terms deliberately state no amounts: current prices are shown on the pricing page, and the price displayed in the checkout is the one that applies. We may offer introductory prices limited in time or quantity ("founder terms") as well as discount codes. Discount codes apply only to the products indicated with them, cannot be combined with other codes and create no entitlement to future discounts. The discount is displayed in the checkout before you buy.
§ 6 Step consumption, expiry and re-credit
A research run consumes steps per stop of your route; deep research consumes twice as many steps per stop as standard research. If you edit a finished report, the edit consumes steps only for the stops that are searched again, at the same rates as above, but at least one step, even if no stop is searched again. We show you the steps for an edit before you submit it. Your remaining allowance is shown in the app. Consumed steps are not re-credited if you cancel a running research or do not use the result. If a research step fails for technical reasons within our responsibility, we re-credit the affected steps automatically. If a research run finds no accommodation at all for a stop, we automatically re-credit the steps for that stop. If deep research cannot be carried out in full for an individual stop, we deliver that stop from the standard research, mark it as such in the report and automatically re-credit the surcharge for that stop. Steps from the Pro purchase and from step packs never expire; they do not, however, replenish by themselves either. On the forfeiture of steps when you delete your account, see § 13. The free allowance is one-time and does not renew (§ 2).
Booking steps. If your report shows a line about booking steps at a partner's booking button, we credit you additional steps for a paid hotel booking made via that link from that report ("booking steps"): 50 if, while the programme was running and before the credit, you opened the report you booked through with Pro at least once, otherwise 25. Only stays that actually took place count, and only bookings made after we started the programme for that partner. We credit the steps only once the partner has finally confirmed the booking after your stay; this can take several weeks. Cancelled bookings do not count. Booking steps do not expire, have no monetary value, are not paid out and are not refunded in money; they are used after your free or Pro allowance and before purchased steps. We may end the programme for future bookings at any time; booking steps already credited remain.
Chargeback of a payment. If you have a payment to us reversed through your bank or card issuer, we suspend, until it is resolved, only the purchase this payment belongs to. Your other purchases remain usable. If you have already used steps, the disputed purchase counts as used first. We therefore suspend only the steps left over after your other paid purchases. Example: you have two purchases of the same size and have used as many steps as one of them contains. If one of them is charged back, we suspend no steps.
If the disputed purchase is your Pro purchase and you have no other paid Pro purchase, Pro is also suspended until it is resolved. During that time the lower step pack price for Pro (§ 2) does not apply, and new reports for which you use no purchased steps are, like free reports, accessible for a limited period only (§ 2). Such a report is deleted when that period ends. If we lift the suspension before then, it is kept permanently; lifting it later does not bring it back. Reports you created before remain.
If we suspend steps or Pro when the chargeback arrives, we tell you by e-mail what is suspended and why. If steps later flow back from a report that was already running before the chargeback and then fails, is stopped or is only partly delivered, we suspend them as well, without a separate e-mail. We tell you what is suspended at any time on request. You can tell us your side and ask for a person to review the suspension. If your bank decides in our favour or you withdraw the chargeback, we lift the suspension without delay. If your bank finally returns the money to you, this purchase counts as unpaid. You then no longer receive what is suspended from it. Your other purchases are not affected. Our claim to payment for steps you have already used from this purchase remains. Your statutory rights remain unaffected, in particular your rights in case of defects (§ 8) and your right to withhold payment as long as we do not perform as agreed.
§ 7 Right of withdrawal and early expiry
As a consumer you may withdraw from a distance contract within 14 days of its conclusion without giving reasons (§ 11 FAGG). The Pro unlock and step packs are digital services (§ 18 para 1 no 1 FAGG). If, at checkout, you expressly request immediate performance before the withdrawal period ends and confirm your awareness that the right of withdrawal is lost once performance is complete, then: (a) your right of withdrawal expires only upon complete performance of the service (§ 18 para 1 no 1 FAGG), not already when performance begins; and (b) if you withdraw before that, you owe a proportionate amount for the performance already provided (§ 16 FAGG). We obtain this request and confirmation via a separate mandatory checkbox at checkout; it applies to the Pro purchase as well as to step packs. Full withdrawal instructions and the model withdrawal form: right of withdrawal.
§ 8 Warranty
Statutory warranty law applies. For digital services the Austrian Consumer Warranty Act (VGG) additionally applies, including our obligation to provide the updates necessary for the service to remain in conformity with the contract (§ 7 VGG). We provide these updates for the entire period during which we provide the service to you. Nothing in these terms excludes or limits your statutory warranty rights (§ 9 KSchG).
§ 9 AI-generated content and third-party information
Briefings and recommendations are generated automatically with the help of artificial intelligence and are labelled as such. AI-generated information (for example assessments of prices, or statements about amenities, location, distances or reviews) can be incomplete, incorrect or outdated. Always verify booking-relevant information directly with the respective provider before booking. Our content is editorial research assistance, not travel, legal or other professional advice.
Prices, availability and accommodation details originate from the booking platforms; derived figures such as the total price and per-person amounts are calculated by us from the platform's figure. They are neither an offer nor a price commitment on our part; the contract for the accommodation is concluded exclusively between you and the respective provider. Platform prices may be stated as an average across the requested period and excluding taxes, duties and fees; only the provider states the amount payable. The status changes continuously. The underlying data comes from third parties and can be incomplete, wrong or out of date, for example when a provider changes prices or availability after our query. Our service is research and editorial preparation. Your statutory warranty and damages claims against us remain unaffected (§ 8, § 12).
§ 10 Affiliate links and disclosure
Outbound links to booking platforms can be affiliate links for which we receive a commission if you book. Affiliate links are currently active; we mark them directly at the respective link ("partner link"). The provider pays our commission out of its own share; it is not added to your price. Commissions have no influence on the order or rating of our recommendations. Which properties enter our rating at all is determined by the booking platform's sort order and by our own selection from the platform's hotel data file (a city's quality list and properties around your places); for the booking platform's pre-selection we cannot warrant freedom from commission influence. How we rank is explained at Ranking.
§ 11 Beta, changes to the service and availability
TripBriefing is under continuous development; individual features may be labelled as beta. We may change the service to the extent the change is reasonable for you, in particular because it is minor and objectively justified (§ 6 para 2 no 3 KSchG); the core of services you have already paid for (your purchased step allowance and the Pro features) remains unaffected (see also the grandfathering rule in § 2). This does not apply to the suspension in case of a chargeback under § 6. It does not change the service but holds it back as long as the payment is disputed. There is no entitlement to uninterrupted availability; short interruptions (e.g. for maintenance) are possible.
§ 12 Liability
We are liable without limitation for damage resulting from injury to life, body or health (personal injury, including in cases of slight negligence) and for other damage we cause intentionally or through gross negligence. For other damage caused by slight negligence, liability is excluded. The operators of linked third-party sites (e.g. booking platforms) are solely responsible for their content and services.
§ 13 No subscription, end of contract and account deletion
Pro and step packs are one-time purchases: there is no subscription, no recurring billing and nothing to cancel. You can delete your account yourself at any time in your account area, or request deletion informally by e-mail to founder@tripbriefing.ai. Upon deletion, unused steps (including booking steps, § 6) lapse without replacement and access to stored reports ends. Statutory retention obligations (e.g. for purchase records) remain unaffected; details in the privacy policy.
§ 14 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 19 AStG). For complaints you can reach us at founder@tripbriefing.ai. For information: the arbitration board competent for online transactions in Austria is the Internet Ombudsstelle (ombudsstelle.at).
§ 15 Governing law, jurisdiction and final provisions
Austrian law applies. If your habitual residence is in another state, the mandatory consumer protection provisions of that state remain available to you (Art 6 Rome I Regulation). For actions against consumers domiciled in Austria, the place of jurisdiction under § 14 KSchG applies (domicile, habitual residence or place of employment). Should individual provisions of these terms be invalid, the remainder of the contract remains valid; the statutory rules replace the invalid provision. Version: 3 November 2026.
